New Open Records Request, As Requested By Sheriff Supporters

Chua Supporters Admit Smith Allowed Computer Use

After lingering in a county jail in Georgia since his arrest in September of last year for murder charges, Dr. Noel Chua - a Filipino-American internist - will soon have his day in court. Charged with double murder for the accidental death of a patient, Dr. Chua’s case has become an international cause celebre.
On September 13, 2006, after a lengthy investigation, a Camden County, Georgia grand jury indicted Dr. Chua of two counts of felony murder - of the same person, James Carter III -- and 17 counts of violation of Georgia’s Controlled Substance Act. Dr. Chua was denied bail and is currently held in the Camden County jail. In addition to these charges, the prosecuting District Attorney, Steven Kelly, also charged Dr. Chua with RICO racketeering.
As a result of the racketeering charge, which according to Dr Chua had no legal basis, the court ordered his assets frozen and at the same time appointed a Receiver, an act that was never explained. Since Dr. Chua’s assets were frozen, why is there a need for a Receiver? At the time his assets were frozen, Dr .Chua had $120,000 in cash in his bank accounts. When he recently requested a copy of his bank statement, there was only $10,000 left in cash. It was also revealed that the Receiver has billed nearly $100,000 for his work. Doing what?
A few days ago, I received from the Camden County Sheriff’s office a fax copy of a motion filed by Donald F. Samuel, Dr. Chua’s lawyer, to dissolve the RICO receivership and to dismiss the RICO lien notice. One of the bases for the motion was the fact that “there has never been a hearing to support the seizure of Dr. Chua’s assets.” The motion further stated that “the evidence that has developed as a result of the discovery that has been taken demonstrates that Dr. Chua did not commit any crime.” It also asserted that Dr. Chua did not violate RICO or any other criminal law and that he prescribed medicine to the patient based on a legitimate medical need. The motion further stated: “The fact that the patient eventually abused the drugs and either intentionally, or unintentionally overdosed is not the basis for a criminal charge against Dr. Chua.”
The motion questioned the need to appoint a Receiver: “Dr. Chua’s defense, including the payment of necessary expert expenses, will take a back seat to the Receiver’s unquenchable thirst for more of the assets.” The motion asked the court to dissolve the RICO lien notice and to dismiss the Receiver.
Adding insult to an injury, the Receiver asked the court for permission to refer “potential improprieties” for further investigation of potential insurance fraud. In a separate court filing, District Attorney Kelley said that Judge Amanda Williams should order the Receiver to report his findings. Meanwhile insurance investigators are looking into Receiver’s allegations. What is really sad is that the Receiver, who was appointed to take care of Dr. Chua’s estate and business while he is being held in jail without bail, appears to be partial to the prosecution and, in my opinion, may have violated his fiduciary duty to Dr. Chua.
After nine months of delay - the trial was originally scheduled to start November 2006 - Dr. Chua is finally going to have his day in court. Jury selection is going to start on August 20 and the trial on September 10. Recently, the District Attorney filed a motion to transfer Dr. Chua from the Camden County jail to another county jail. He believes the DA is trying to isolate him from his family and supporters.
It is interesting to note that Camden County Sheriff Bill Smith is sympathetic to Dr. Chua. As a matter of fact, he has allowed Dr.Chua to use one of the computers at his office which enabled Dr. Chua to communicate with his family and supporters.
Some of the leaders of Dr. Chua’s supporters in Georgia are Marilyn Doromal, Willy Blanco, Ding and Rosa Tamisin, Jason White, Robert McLaughlin, Toni Daya-Luetger, Dr. Mike Tan, Cris Borja, Dr. Ely Abellera, Scott Alexander and Pam Peterman. With Dr .Chua’s assets virtually gone, his supporters in Georgia have raised $140,000 and are trying to raise another $25,000.
Dr. Ely Abellera of Fairburn, Georgia, one leader of the Georgia Advocacy for Justice, sent me a letter, “A TEST OF OUR UNITY -- AN APPEAL,” which I posted in my online newsletter BALITA-USA. Within minutes, several people responded. The first to respond was Linda Nietes of Southern California followed by Lydia Soriano of Los Angeles, Manuel Valle of San Jose, Edna Concepcion of San Diego, and Dr. Yoyoy Serina of Southern California.

He is a rare member of the human race, who is just too good for his own good! How many doctors give patients their home phone number, their cell phone number, accept calls gladly in the middle of the night, and call to check on patients at home, plus make home visits when required.”
Dr. Chua wrote me a few days ago and said, “It’s time for the whole truth to come out. It’s been hidden for so long. My friends in Camden are opening their homes for all our out-of-town friends that are coming for the trial.”

TRSP Review: Now they admit to it, Remember the court requested the records from Topix, and everyone swore up and down he was not on the computer, but now I guess since the records will or have shown that he was on the computer they will just come out and say it.
Sheriff Smith what do you have to say? Why are you using the Sheriff's Office to send out information on this case? Why are they receiving faxes from the Sheriff's Office? Will you use the drug fund to pay his/your lawyer?

Drug Audit Sent To Feds
I got an email last night that stated that someone copied the drug audit off my blog and sent it to the U.S. Attorney's office. It did not say whether or not it was requested by the office or if they just sent it in.
This is very interesting as I have heard many have called the number above to complain about the Sheriff.
I think the fact that the DA and Amanda Williams don't trust the Sheriff speaks volumes, So why should we trust him?

Why The Chua Case Is In Brunswick, One Word Smith
You know it is sad when even court judges can't trust a Sheriff. Here is the word on the streets.
In preparation for the hearing to determine the location of the trail, ADA Jackie Johnson had subpoenaed everyone that knew or could know about Dr. Chua's preferential treatment. Rumor has it that all of the following were subpoenaed: Smith, Jailers, The Lang Marina guys that towed in the boat from Cumberland Island with Chua in it, and some of the other passengers on board. Rumor also has it that one of the other ADA's has a cell photo of Dr. Chua wondering around the old courthouse, and the DA also has the proof that he was on the Internet( This is important because some Chau supporters have claimed that Topix was not able to provide information to the the court, My sources tell me otherwise).
Now Dr. Chua originally had Bob Crowe from Brunswick as his attorney, but when Smith heard of the change of location hearing he brought in his own lawyer, Don Samuels from Atlanta. Another lawyer paid with the drug fund money. If you don't believe this is Smith's Attorney look at the post"What Did Bill Do" about 7 post down, the first couple of lines that tell the attorneys for Smith, in the case were the court found he had lied.
Word on the street is that when Smith found out of all these other subpoenas he was "frantic". He knew that if the hearing went forward that Amanda Williams would hold him responsible for violating his oath of office and his oath as the jailer for Camden County. Rumor has it Smith was even talking about invoking the 5th amendment. So, the morning of the hearing Smith tries to talk to Amanda Williams and she refuses to speak with him. So from what everyone can figure out is Bill tells Samuels, to agree to whatever is necessary to avoid the hearing and thus keep Smith off the stand.
The DA proposes moving the trail to Glynn and having Glynn County Sheriff's Office handle the trail and Camden jurors. This would prevent Smith from bribing or getting to a juror. Remember it only takes 1 for a mis-trail. And of course the defense eagerly agrees. So that is why there really was not any hearing and the location was moved. I received this info last night in an email and had three others confirm that this is exactly what happened. But with that said I have not heard this from anyone actually involved in the case as they refuse to comment as the gag order is still in effect.
TRSP Review: So you have a Judge and a DA that can't even trust the Sheriff to watch a prisoner. Does anyone else think that is strange. I would say that those two should step up and do something, but maybe they are waiting to after this trail, because of the gag order. A lot of what Bill has been doing for years came out in this pre-trail phase. The question is will the court do anything about it?
Many Chua Supporters have said Chua is out of money. Who will pay for his new lawyer? Will Smith use the Drug Fund as he has in the past? We will watch and see.

WOODBINE - Jury selection is scheduled to begin today in Brunswick for the upcoming trial of a St. Marys physician facing murder and drug charges. -------------------------------------------------- --------------------------------------------------
Noel Chua, 45, has been held at the Camden County jail since his arrest in September 2006 for the drug overdose death of 20-year-old Jamie Carter III in the doctor's Osprey Cove home on Dec. 15, 2005. Carter was Chua's patient and housemate at the time.
Nine months after Carter's death, a grand jury indicted Chua and charged him with murder and 17 counts of prescribing drugs to the victim for no apparent medical reason.
Chua has had widespread support from his former patients and friends who say Carter was addicted to narcotic painkillers and his death was accidental. Supporters have petitioned to have Chua released on bond until the trial and raised thousands of dollars to support his legal defense.
Carter's family has remained relatively quiet about the criticism by Chua supporters, who describe him as a "drug seeker." Carter's family said the trial will show the doctor's unusual relationship with their son and how the drugs prescribed to him led to his death.
Superior Court Judge Amanda Williams took the unusual step about two months ago to move the trial from Woodbine to Brunswick as a way to limit the involvement in the case of Sheriff Bill Smith, an unabashed supporter of Chua. Typically a trial is only moved at the request of defense attorneys, but Chua's lawyers never filed any such motion.
Instead, Williams made the decision to move the trial at the request of both prosecutors and defense attorneys prior to a hearing in August. The District Attorney's Office was expected to express concerns at the hearing about Smith's public support of Chua and the apparent preferential treatment he was receiving while being held in the county jail.
Smith has publicly stated he didn't believe Chua was guilty and supported his release from jail on bond until the trial. Smith also said he and Chua went to China in the spring of 2006 to seek alternative forms of treatment for Smith's son, Blake Smith, who is paralyzed from an automobile accident.
The judge's ruling means Camden County deputies will bring Chua to and from the Glynn County Courthouse each day. But they will not be allowed to have any interaction with any of the jurors, Williams ruled.
During the jury selection, both the defense and prosecution will have nine strikes to eliminate potential jurors without explanation. But the jury pool is expected to be whittled down with the general questions that will be asked of everyone.
The questions include: whether they are related to anyone involved with the prosecution or defense; if they have ever been one of Chua's patients; do they have a bias toward the prosecution, defense or defendant; do they have an opinion of Chua's guilt or innocence; and can they be impartial and consider all the evidence before forming an opinion in the case.
Because of extensive pre-trial publicity, the list of potential jurors is sealed and the final group of 12 jurors and three alternates will be sequestered for the entire length of the trial, expected to last about five days.

Superior Court Judge Amanda Williams took the unusual step about two months ago to move the trial from Woodbine to Brunswick as a way to limit the involvement in the case of Sheriff Bill Smith, an unabashed supporter of Chua. Typically a trial is only moved at the request of defense attorneys, but Chua's lawyers never filed any such motion.
Instead, Williams made the decision to move the trial at the request of both prosecutors and defense attorneys prior to a hearing in August. The District Attorney's Office was expected to express concerns at the hearing about Smith's public support of Chua and the apparent preferential treatment he was receiving while being held in the county jail.
Smith has publicly stated he didn't believe Chua was guilty and supported his release from jail on bond until the trial. Smith also said he and Chua went to China in the spring of 2006 to seek alternative forms of treatment for Smith's son, Blake Smith, who is paralyzed from an automobile accident.
The judge's ruling means Camden County deputies will bring Chua to and from the Glynn County Courthouse each day. But they will not be allowed to have any interaction with any of the jurors, Williams ruled.
During the jury selection, both the defense and prosecution will have nine strikes to eliminate potential jurors without explanation. But the jury pool is expected to be whittled down with the general questions that will be asked of everyone.
The questions include: whether they are related to anyone involved with the prosecution or defense; if they have ever been one of Chua's patients; do they have a bias toward the prosecution, defense or defendant; do they have an opinion of Chua's guilt or innocence; and can they be impartial and consider all the evidence before forming an opinion in the case.
Because of extensive pre-trial publicity, the list of potential jurors is sealed and the final group of 12 jurors and three alternates will be sequestered for the entire length of the trial, expected to last about five days.

I just spoke with a lady that had called Judge Williams number to ask for Dennis Perry's plea be thrown out and to grant him a new trial. Guess what? As soon as Dennis' name was mentioned, the secretary or whoever she was got very cold and told the lady she would have to send the judge a fax or write her a letter. AND THEN SHE WOULDN'T GIVE HER THE FAX NUMBER!! She was told she would have to write a letter..which the lady has done. Does that tell you there is something wrong with this case? You people in Camden County better wake up and smell the roses before you find yourself in the same position that Dennis is in. He isn't asking to be released. Just for a FAIR trial!!
